VapeCycle Incentive Programme

Terms and Conditions. 

We, VEC LIMITED, of PO Box 14086, Panmure, Auckland 1741, New Zealand (“VAPO”, “VEC LIMITED” “We”, “Us” or “Ours”) make available to VAPO customers (“You”, “Your” or “Customer(s)”) the VapeCycle Incentive Programme operated in VAPO retail stores (“Programme”), subject to the terms and conditions contained herein (“Terms”).

By participating in the Programme, You agree to be bound by and to abide by these Terms.

Programme Details 

 The VapeCycle Incentive Programme is a customer recycling incentive aimed at encouraging responsible disposal of used vaping products.

How to Participate:

• Customers return used vaping products (including VAPO and competitor products) to any participating VAPO retail store and discard them using designated VapeCycle bins.
• Customers then enter their details using the in-store iPad survey system, confirming participation in the VapeCycle programme. This is the only valid method of entry.

Offer:

• Each month, 10 winners will be randomly drawn to receive a $500 Prezzy Card voucher.
• Draws will be conducted using approved random selection software.

1. Customers are entitled to 1 entry per day upon recycling at least 1 vape waste item and completing the iPad entry. Multiple entries are permitted if made on separate days.
2. The Programme commences on 1st July 2025 and will run indefinitely until terminated or amended by Us.
3. The Programme is only available in physical VAPO retail stores during normal operating hours.
4. The Programme is open exclusively to members of the general public who are:
   
   • Residents of New Zealand and physically located in New Zealand at the time of participation;
   • 18 years of age or older;
   • Current smokers or vapers;
   • Able to provide valid photo identification for age verification, if required.
5. The Programme is not open to trade customers, resellers, or retailers.
6. Both VAPO and competitor branded vaping products are eligible for recycling and entry under this Programme.

Prize Conditions

1. Winners will be notified in writing within 10 working days of each monthly draw.
2. To claim their prize, winners must provide:
   • Full name
   • Email address
   • Residential address
   • Valid photo ID
3. Prizes will be dispatched digitally via electronic delivery where possible. Physical delivery will be used only where electronic delivery is not feasible. We are not responsible for postal delays or incorrectly provided information.
4. Prizes are non-transferable, non-exchangeable, and non-refundable, except as required by applicable law.

General Conditions

1. Participation in this Programme constitutes acceptance of these Terms. Failure to comply with any of these Terms may result in disqualification.
2. All personal data collected in connection with the Programme is collected, used and stored in accordance with Our Privacy Policy (https://www.vapo.co.nz/pages/privacy-policy).
   
3. VEC LIMITED reserves the right to verify the eligibility of any participant and may, at its sole discretion, disqualify any individual who tampers with the entry process or who breaches these Terms.
   
4. We reserve the right to decline any participation at our sole discretion without limitation.
   
5. No refunds, returns, or exchanges will be entertained except as required by applicable law.

Liability 

With the exception of liability which cannot be limited or excluded by applicable law, We (including Our Affiliates, related companies and their and Our respective officers, agents and employees) exclude and limit all applicable liability, including for death, personal injury, loss or damage (including loss of opportunity and whether direct, indirect, special or consequential) suffered or incurred by any person (whether or not arising from any person's negligence) arising in any way out of or in connection with the Programme or the Offer. Without limiting the aforesaid this shall include: a) theft, mail delivery failure, unauthorised access or third party interference; b) any technical difficulties or equipment malfunction (whether or not under Our control); c) any tax liability incurred by You including self-assessed tax liabilities; d) Your participation in or use of the Offer.

Customer indemnifies and will keep indemnified VAPO against all loss and damage whatsoever suffered (including but not limited to indirect or consequential loss) by VAPO arising out of any failure of the Customer to adhere to these Terms.

Health Disclaimer

VEC LIMITED electronic cigarettes may be hazardous to health and contain nicotine which is addictive. VEC LIMITED electronic cigarettes are not suitable for use by: persons under the age of 18; persons who are allergic/sensitive to nicotine; pregnant or breast-feeding women; persons who should avoid using tobacco or nicotine products for medical reasons; or persons with an unstable heart condition, severe hypertension or diabetes. Keep VEC LIMITED products out of reach of children. 

Governing Law

These Terms, and any dispute or claim arising out of or in connection with it or its subject matter or formation shall be governed by, and construed in accordance with the laws of New Zealand.

Each party irrevocably agrees that the courts of Auckland, New Zealand, shall have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with this Programme and the Terms.

We reserve the right to change, amend, withdraw or cancel this Programme or these Terms at any time without notice and in our absolute and sole discretion.
